The only precedence to draw on that we have for legal matters concerned with the possession of images is the experience under child pornography laws. Under Operation Ore, the UK's largest investigation into online child pornography, the British police went to magistrates to ask for search warrants using no more than credit card details provided by US authorities.[1]
However, in July 2006 the European Court of Human Rights judged that in the case of a man who sued the UK police after they raided his house looking for someone else the police had not done enough to ensure the man they were looking for was at the address. [2] This may effect the granting of future warrants purely on the basis of internet derived information (see also the European Directive on Data Retention).
