I have posted a file that sets out the case law in relation to the Obscene Publications Act and the European Convention on Human Rights, with a summary on page 10 for those faint of heart!
The purpose of this exercise is two-fold: To help us to avoid arguments that are inconsistent with the existing law since we are not campaigning to change existing laws. To identify the proposal’s greatest weaknesses within the ECHR framework. I am not a human rights lawyer, so if someone who knows better disagrees with what I have written, please feel free to say so. I won't be here to disagree as I'm off on my hols :)
